BUYER / CONSUMER:
Any individual who accesses, accepts this agreement electronically, and completes a purchase or membership through our online platform (melikesummer.com and melikesummershop.com). To preserve the limited, boutique nature of our craftsmanship, wholesale or institutional commercial purchases are strictly excluded from this platform.

2. SUBJECT & LEGAL SCOPE
This Distance Sales Agreement ("Agreement") is issued in strict compliance with the Turkish Act No. 6502 on Consumer Protection and the Regulation on Distance Contracts published in the Official Gazette No. 29188. The parties hereby acknowledge, understand, and accept their mutual rights and executive obligations under these legal frameworks.

3. GENERAL PROVISIONS

3.1. This Agreement becomes legally active on the exact date and time it is electronically confirmed by the Buyer during checkout. Obligations and liabilities remain strictly with the signing parties.
3.2. The Buyer declares that they have reviewed, understood, and electronically confirmed all preliminary information regarding the primary features of the selected designs, final sales prices (including applicable duties), secure payment methodologies, and explicit delivery protocols prior to completing the transaction.
3.3. The Seller is legally responsible for ensuring that each design is meticulously packaged in accordance with its premium specifications, remaining whole, undamaged, and complete upon dispatch.
3.4. The products shall be delivered securely via courier to the designated address provided by the Buyer. If the recipient is absent during delivery, the Seller is deemed to have fulfilled its obligations entirely. Any risk, losses, or transport costs resulting from the Buyer providing inaccurate address data or failing to receive the parcel shall be borne solely by the Buyer.
3.5. Free shipping is gracefully provided for all deliveries within Türkiye. International shipping fees and cross-border customs infrastructure remain the financial responsibility of the Buyer and are calculated transparently at checkout.
3.6. The Seller is immediately released from any obligation to deliver or supply the creations if the payment transaction is cancelled, unauthorized, or declined by the relevant banking institutions for any reason.
3.7. If unauthorized or unlawful credit card usage occurs post-delivery (without the fault of the Buyer), and the bank declines payment to our studio, the Buyer is legally obligated to return the pristine item to the Seller within 3 days. Return courier costs in this rare event belong to the Buyer.
3.8. Interest rates and delay interest policies are strictly governed by the individual credit card agreement between the Buyer and their financial institution. The Seller carries no liability or intervention over banking terms or installment refund structural schedules.
3.9. In the event of a valid cancellation or refund, the Seller will return the collected amount to the Bank in a single transaction. Pursuant to international banking protocols, the Bank may reflect this credit to the Buyer’s card in sequential installments, depending on the initial payment structure chosen by the Consumer.
3.10. In compliance with the General Communiqué on Tax Procedure Law No. 385, the relevant return sections of the original invoice must be accurately filled, signed, and returned along with the item to legally process a refund transaction.

4. LIMITATIONS OF USE & PLATFORM INTEGRITY

4.1. The online boutique (melikesummershop.com) operates strictly as an extension of the main brand sanctuary (melikesummer.com) to offer premium textiles, accessories, and exclusive patterns.
4.2. To maintain the security and prestige of our digital atmosphere, the Seller reserves the right to suspend accounts, decline transactions, or restrict access if a User engages in:
- a) Dissemination of unauthorized political or ideological broadcasts.
- b) Provision of false or fraudulent personal information.
- c) Payment and trade manipulation or fraudulent activities.
- d) Intentional actions designed to cause commercial, legal, or digital harm to the brand ecosystem.

5. RIGHT OF WITHDRAWAL (CANCELLATION & RETURNS)

5.1. Pursuant to consumer protection legislation, the Buyer maintains the right to withdraw from this Agreement and return the selected designs within 14 (fourteen) days from the date of delivery, without penalty and without stating any justification.
5.2. Upon receiving the official notice of withdrawal through our communication channels, the Seller will process the product refund within 10 (ten) days after the item safely returns to our atelier and passes our mandatory quality control inspection.
5.3. EXCLUSIONS FROM THE RIGHT OF WITHDRAWAL:
In accordance with distance sales regulations, the right of withdrawal cannot be exercised for:
- a) Goods or services whose prices fluctuate based on financial markets outside the direct control of the Seller.
- b) Creations customized, personalized, or altered according to the specific measurements, unique demands, or personal needs of the Buyer (including customized limited-edition silhouettes).
- c) Intangible goods delivered instantly in electronic environments (such as digital gift vouchers or promotional codes).
- d) Premium garments and accessories whose hygiene seals, protective elements, or original packaging have been opened, altered, or compromised post-delivery.
- e) Orders delivered to international addresses outside the Republic of Türkiye, unless the Buyer agrees to bear all return international shipping expenses, customs clearance tracking, and applicable cross-border import duties. Any staining, perfume odors, or structural harm caused to the premium fabrics will immediately invalidate the right of withdrawal.

6. DEFAULT & BREACH
If either Party fails to fulfill their explicit obligations under this Agreement without a justifiable cause, the provisions of default under the applicable Code of Obligations shall apply. The non-defaulting party shall provide a 7-day notice to allow the other party to rectify the breach. If performance is not achieved within this timeframe, the aggrieved party maintains the legal right to terminate the contract and demand a full restitution of verified funds.

7. FORCE MAJEURE (UNFORESEEABLE EVENTS)

7.1. Neither Party shall be held liable for any delay or failure in performance resulting from an event of Force Majeure arising after the execution of this Agreement. Force Majeure defines acts of God, natural disasters, wars, terrorism, civil unrest, sudden legislative embargoes, national labor strikes, or widespread digital infrastructure failures that are beyond the reasonable foresight and control of the Parties.
7.2. The affected party must promptly notify the other party in writing. If a force majeure disruption extends beyond 10 (ten) consecutive days, either party maintains the right to terminate the transaction unilaterally without legal liability.

8. PRIVACY INTEGRITY
By confirming this transaction, the Buyer acknowledges that they have read, understood, and agreed to the data protection standards outlined within our integrated Privacy Policy.

9. JURISDICTION & COMPETENT COURTS
Any dispute arising from the interpretation or execution of this Agreement shall be submitted to the authorized Consumer Arbitration Committees up to the legal monetary thresholds declared annually by the Ministry of Commerce. Disputes exceeding these thresholds shall fall under the exclusive jurisdiction of the competent Consumer Courts and local enforcement directorates in the Republic of Turkiye.
